STU DIES July 23, 2009! Mark your calendar.

What?! That's right. The only thing keeping Stu alive right now is that the Court decision does not become final for 30 days after the ruling. The ruling was issued June 23, 2009--ONE DAY after Board President Tariq Khero and City Attorney Dov Lesel assured the public that there would be NO COURT DECISION for several weeks....at least. Let's listen, shall we?
(audio clip to come).

THE DEPARTMENT OF ANIMAL SERVICES CAN KILL STU ON JULY 23
AND THERE IS NOTHING TO STOP THEM--
EXCEPT YOU.

The Board first took up the matter of revisiting Stu's case and his horrible care in the pound in May 2007. Several attempts were made by the Board to place the issue of Stu on the Board's agenda. All of them were blocked by Ed Boks and Linda Barth. Finally, after 3 months, the Board voted on August 27, 2007 to move Stu from the pound to Bobby Dorafshar's K9s Only facility for the duration of the legal proceedings.

Then we went through 2 years of Court proceedings and brief-writing, etc., etc. City Attorney Todd Leung lied to the Court in his briefs and blocked any attempt to allow the truth into the case.

So, here we are. The City had been successful in keeping the truth that Stu did not receive a fair hearing out of the Courts. Saving Stu and sending him home is now in the hands of the City government. Here's what has to happen:

  1. The Board must call and hold a Special Meeting before July 13, which is the next regular Board meeting. The president may call the meeting or 3 Commissioners may call the meeting. As of this writing, no one has called a meeting. At this meeting, which is not scheduled, the Board must discuss the recommendation which they will make, in writing, to Council and the Mayor.
  2. At the regular meeting on July 13, the Board must vote to send the recommendation to Council. Council will either refer the matter to the Public Safety Committee or the PS Committee may waive consideration and refer the matter back to the full Council. The City Attorney will advise Council on what powers they have to Save Stu and send him home. Because of the red tape that a recommendation will encounter, the Board must also vote to stay the order to kill Stu for 60 days to allow the matter to work its way through the bureaucracy.
  3. If the Council votes to make a recommendation to the Mayor, then the Mayor will decide upon the recommendation.
Meanwhile, Board members AND THE PUBLIC may lobby Council members in favor of the recommendation. City Attorney Dov Lesel told them this on June 22, 2009-- that they may contact Councilmembers as individuals or as a Board.

Here's what's happened so far:

Members of the public , and myself, have urged the Board to hold a Special Meeting. The president, Tariq Khero OR 3 Commissioners may call a meeting with 24 hours notice. The Brown Act does not prohibit Commissioners from discussing the setting of a Special Meeting.

Here's what the Board has done: NOTHING.

Here's what you can do: Demand that a Special Meeting of the Board be called before July 13.

Email or preferably FAX your demand that the Board call and hold a Special Meeting before July 13.

  1. FAX the Board 213-482-9511. On your Fax COVER SHEET, direct the Board Secretary to forward your fax to ALL Boardmembers IMMEDIATELY.
  2. FAX Board president Tariq Khero at his office:

Nasatir, Hirsch, Podberesky & Genego,PLC FAX: 310-392-9029 [corrected]

  3. Call Tariq Khero at his office: 310-854-4170
  4. Email all Boardmembers and REQUEST A REPLY: tariqkhero@gmail.com,
    ninekitties@aol.com, ireneponce@earthlink.net, secundar@unitedtalent.com,
    ajq1trq2@aol.com
  5. CC Jeff on your emails: stu.911@gmail.com
  6. Flood Animal Services' phones with calls demanding a meeting of the Board

This is beyond outrageous on more levels than we can count. This dog has done nothing wrong!! To be deemed vicious from ONE bite while having been injured and in pain is ludicris. You have the experts opinons to back this up. This poor animal has spent 4 years held in doggie jail away from his loving owner. We believe that is punishment enough for trying to protect himself from further injury or pain. Return this dog immediately to his owner!

    This is unacceptable !

  4. I am appalled and upset that this case is still going on. I will help fight for STU's rights however I can. This is one of the most ridiculous cases ever. (Yet, I'm sure there are more!!) I will be on STU's side forever.

  5. This is just unacceptable behavior on the part of the City Attorney Todd Leung, Ed Boks, Linda Barth.

This dog has suffered long enough and in no way, should be put to death because "someone" may have a vendetta, or just not like Stu. This is what it sounds like to me. To keep this poor dog locked up for 4 years and then KILL him?! That makes no sense whatsoever!

A life being taken "just because they can"...wow that's compassion at it's finest. Do you people not understand also, the phychological damage you've already caused to Stu's family, or does that not even matter?

Now to demand that Animal Services do your dirty work, when probably most of those people aren't in agreement with killing him either, is just as cruel. This dog is considered a senior now and should be allowed to live the rest of his days in his home with the people who love him.

Why is it so much to ask for when the facts are clear that Stu has done nothing wrong except to bite out of fear from his own injury. Most people with any basic knowledge of animal behavior knows a dog may bite out of fear when injured. So how does this justify 4 years in hell and then be executed because of someone else's ignorance?

  7. This is so cruel, evil, and unethical. Our animals, I mean all our Little Angels, that love us without any judgement, deserve LOVE, RESPECT, AND COMPASSION!

  8. How unjust is this? Is this the American way? To torture and then kill an animal? I do not want my children nor grandchildren to make aware that you people think this is just. This is animal cruelty know matter how I look at it. To put this dog in a cage for 4 years and then kill it. Is this the right way? I do not think so. Any animal that is injured and scared will bite. News flash for you people making this evil chose. I can only say, look into your selves and see if there is one ounce of compassion and feelings of your heart. Let me tell my children that there are people out there that are good, smart, and caring people. The only reason I would think that you would put this dog down is the 4 years of torture in this small cage and know human contact and mentally not right from the torture. If this is true than I think that you are someone I have lost all respect for. Please reconsider your choice and really look at what you are doing. This animal is not just a number on a page. I do not care if you know my name because I am proud to speak out for this poor animal. Pam Mendoza. Thank you for listening.

  9. PLEASE, I IMPLORE you, PLEASE save this precious creature and allow him to live a healthy, happy life as he was meant to. He should be happy and being loved and that's it! No more of this, it's insane already. SOMEONE HELP HIM, I beg you.

  10. The fax number above, 310-392-9209 is not a working number. Did Khero's office have this number disconnected because too many people are faxing there?

Do you have another fax number?

  11. I was unable to print my name on this comment b/c my computer was acting up. My name is Janice G. from Minnetonka, MN. I am a staunch animal advocate, and strive to bring justice to all animals where there is abuse. I agree with everyones' comments preceding mine. Stu has done nothing to deserve the inhumane treatment that he has been given, and over a four year period; that is insane. Dogs will bite for any number of reasons. It is there way to help defend themselves and/or speak up for themselves when something is not right. I have been bit by my own golden retriever who I rescued two years ago, and I know he didn't mean any harm by it. I have eight animals who I have rescued, and I have zero tolerance for animal abuse and mistreatment. Dogs will be dogs, just like humans will be human. Unfortunately, the latter is much worse b/c they are so much more dangerous, irrational, and lacking in compassion and reasonable judgment. A dog can bite and still be a very sweet, loving and wonderful animal. It's what they do b/c they cannot talk. The human race is constantly hurting one another in much more brutal ways than this. Should be put all those humans down too b/c they kill, maim, and torture others? Rarely do you see that kind of restitution for our own brutality. Show compassion for this sweet, innocent boy, and set him free! Let his guardian take him home where he will receive TLC, which he so rightfully deserves. Think, Use your heads, don't just act!

  14. I know from experience dogs will bite out of fear, or because of an injury. My lab, Lacey, who is very sweet, and has never been aggressive. One day my Rottweiler, Sadie, was playing with Lacey and somehow Lacey's collar got twisted and stuck on Sadie's teeth. I don't know how that happened but it did......Both dogs could not free themselves from each other. The more Lacey was trying to free herself, the more the collars was tightening around her neck. Both dogs started to panic!! I tried to undue the twisted collars from Sadie's mouth, in a panic, and fear Lacey bit me on my arm. I still have the scar from that incident. I never thought she meant to bite me! It was an instinctual reaction. This happened 8 years ago. Lacey is now 11 years old, never once did I ever FEAR that she would bite me, or somebody else again. So come on people, let Stu go home to his family. He's been punished enough

This is a tragic story, and one of criminal abuse proportions. What is the rationale for keeping the dog Stu imprisoned for four years. It's ludicrous. There are many senseless laws on the books that should be eradicated. This particular law holding Stu hostage for four years with no contact with his guardians is cruel and inhumane. If Stu bit someone it may very well have been justified. It is an animals way of protecting themselves b/c they cannot speak up in their defense. I have eight (8) animals of my own; five (5) dogs and three (3)cats, all rescues. My sister and I have been bitten at times, but they do not mean any harm. There are thousands among thousands of wonderful, loving, precious animals who may have, at one time or another, bit someone. It's like telling a child not to scream when they are scared or hurt. Dogs bit. Same difference, different species. As a staunch animal advocate, I fight for the rights and welfare of those who have no voice. Release Stu to his guardians to live the rest of his life surrounded by TLC! That is the humane thing to do, and we urge you to do just that! We will fight for Stu's well-being until justice is served.

  18. This dog should be evaluated by Ceaser Milan bet you he can tell if the dog is vicious or not. Does anyone know how to contact Mr Milan he is the only one that can save this dog. He is the Dog whisperer and has a show on National Geographic. I think if you go to the National Geographic website you can get in touch with him . If you do you should copy and paste the link of this website on the Email you send him. It has to be someone that has a way with words. If I was the owner I would contact him he is a dog lover and his words will probably be heard by the court and they will listen to him. Someone please contact him.

  19. STU NEEDS TO GO HOME TO HIS RIGHTFUL OWNERS, NO ONE HAS THE RIGHT TO TAKE A DOG AWAY FROM ITS HOME AS LONG AS THE OWNER TAKES ALL PRECAUTIONS NECESSARY FOR EVERYONES SAFTY IN WHICH THEY ARE WILLING TO DO. HE DESERVES TO GO HOME WHERE HE BELONGS.

  20. The law on holding an innocent animal in a prison is beyond belief, and the people should get this law changed immediately. Stu should be with his owner, and the courts time would be better spent dealing with real criminals.

For a dog's life expectancy, the authorities already took at least a third of Stu's life away. Shame to all the authorities that are delaying this problem, instead of participating to their meeting and deciding Stu has to return home. Every intelligent human being knows that any animal, and even a human being, if in pain or fear acts aggressively. So, if an innocent sentient living being has to wait for 4 years for you to get together and finally agree there was a huge mistake to take Stu from home and declare him "vicious" because of one bite caused by pain and fear, then God help us all, who need you to decide for our lives!!!

  31. This poor dog has been behind bars for 4 years. What kind of life is that?? How can his owners be in peace knowing this? It would ruin my life if my dog was ever in a cage. I can't believe anyone could do this to a dog. And now they want to kill him? What kind of people can do such a horrible thing to a living, sensitive animal? This story is so upsetting. Return the dog to their owner and let him live out his last years with love. Please.
